    There are mechanisms to stop, apprehend, and punish those who attack and terrorize communities already, without regard to ideology, and without violating the state’s monopoly on civil violence. There’s even recourse when those mechanisms don’t get a fair result.

    Either we settle these disagreements as a civil society, or we settle them with civil war. Talking, or guns. It’s never punching, so you never punch Nazis.

  • Which people are tolerant and which people are intolerant is less obvious than it looks.

    Like if you say “the Jews should be eliminated” then most everyone will recognize you as a Nazi unless you say it in Arabic and have a brown face, at which point punching you is a hate crime.

    With what level of force are you going to attack them? Surely a bloody nose isn’t going to be enough to dissuade them. So are we talking broken bones? Loss of an eye? Or force to the extent that they die from it? After all nothing’s safer than a dead attacker.

    Ok but now you’re the one talking about extermination… so what do we do with you? The problem with the Paradox of Tolerance is that there’s a Paradox of Intolerance, too.

    Not ruled; advised. ICJ advisories are non-binding. Israel’s annexation of the West Bank, which was ceded to them through negotiated agreement with Jordan, is legal under both Jordanian and Israeli law and no other law applies because no other sovereignty applies.

    The ICJ ruling that the United States “unlawfully” annexed Alaska or Hawaii would have similar import: literally none whatsoever. The simple fact is that borders move and land changes hand and the ICJ doesn’t have the authority to say what’s what.

    Israel’s claim to the lands of Judea and Samaria is based on agreements that predate WWII. Israel as a nation is older than several of the countries that make up the European Union, but nobody says that Germany unlawfully “annexed” West Berlin.

    Again there’s no source for civilian casualties in Gaza. Any numbers you hear are estimates based on formulas; they’re not tallies of bodies.

    The IDF’s estimates don’t make them look “bad.” It makes them look like the most moral, most professional army on Earth.

    Yes, in fact it’s been going on for quite a bit fewer years than the Arabs of Palestine have been trying to commit genocide against the Jews. If you don’t think Oct 7 is somehow a brutal act of terrorism by a people who deserve apartheid (at least) as a response, then you can look to the one before that, the one before that, the one before that, and so on and so forth all the way back to the first Arabs invading Judea.

    The Jews of Israel have lived with the Palestinian desire to mass-murder them a lot longer than I would. No more merciful a people than Israelis; no more ungrateful a people than Palestinians.

    The reasoning of "yeah but look what they did" was the reason nazi Germany justified deporting jews to Auschwitz.

    If Jews had, en masse, instituted a pogrom of Germans then the camps would have been justified. But it was the reverse that was true. But the Arabs have been torturing, enslaving, and killing Jews since the first day they colonized Judea.

    What does this statement mean? It certainly can’t mean 1.1 million people have been unable to acquire food and eat it, because they have and have continued to.

    This occurred through the imposition of a total siege over Gaza that involved completely closing the three border crossing points, Rafah, Kerem Shalom and Erez, from 8 October 2023 for extended periods

    It is not a crime of war to besiege an enemy city, nor to deny an enemy people access to a nation they wish to attack.

    How could apartheid be an overreaction to that? How could anything short of the complete extinction of Gaza and all living there be anything but an underreaction? If Mexicans did the same thing to Arizona we’d deploy nuclear weapons on Mexico City. Israel, to its immense credit, is more merciful than any other nation on Earth. And Gazans remain the least grateful people alive.

    I accept the 42,000 casualty figure, but there’s no source for how many are civilians. Certainly some are! But the mistake you’re making is that you’re reading “42,000 Palestinians” and some brainworm is causing you to interpret that to mean “42,000 civilians.” But that’s not what that means - Hamas fighters and unassociated militants are Palestinians, too.

  • Oscar Pistorius probably didn't murder his girlfriend

    He's recently in the news for his early parole, but to my mind his conviction for murder was probably unjust.

    1. The prosecution was not able to rebut his testimony that he fired on what he thought was a burglar in his home. This was a reasonable fear - Pistorius is a double amputee despite his Olympic medals, and he lived in a neighborhood that was particularly attractive to break-in robberies due to the residents' wealth.

    2. The prosecution could not provide a motive for murder - the best they could speculate was that they had had an argument, but the prosecution could not provide details of any supposed argument, nor substantiate it from the testimony of any witnesses who actually would have been able to hear it.

    3. It probably was negligent and contributory to have fired on an "attacker" he could not see, but conversely, had he intended to murder his girlfriend during a spontaneous argument, there's no reason for him to have taken the risk of firing through a door in order to do so.

    The traditional elements of the crime of murder are means, motive, and opportunity. Two of these are stipulated since, by the defense account, Pistorius fired the gun that killed Reeva Steenkamp The prosecution's argument for motive was specious speculation at best, and Pistorius' judicial conviction on appeal represents a miscarriage of justice since there was really no reason given to reject his defense. His original conviction of culpable homicide and reckless endangerment was correct and shouldn't have been appealed.
