The name can be Trademarked, but most of the artists out there aren't willing to cough up the money to do so nor continue fighting to maintain said Trademark. Others were just outright denied copyright and trademark in those areas. Like Malice-Risu, the creator of Primagens, who was denied copyright and Trademark for the species.
